What is mediation?
According to Law no 192/2006 concerning mediation and the profession of mediator, mediation is an alternative dispute resolution by non-adversarial means with the help of a third person trained as a mediator in conditions of neutrality, impartiality and confidentiality . Mediation is based on the trust of the parties in the mediator , regarded as a person in capacity to facilitate the negociation between them and support them in resolving the conflict by reaching a solution which is benefic , efficient and durable for all the parties involved
What happens during mediation?
Mediators help you talk about your conflict and find an agreement to satisfy all of the parties. First, mediators explain the procedure and answer your questions. Then, each participant to the mediation procedure has the opportunity to present his case without being interrupted. Mediators do not make any decision in favor of any of the parties, do not rule the case and do not place the guilt. They help the participants discuss openly their problems and identify durable solutions. Finally, mediators will help the parties to write down the agreement they reached
Why choose mediation?

Mediation makes sense
During mediation, you are in control. You make your own decisions. The solution is given by the persons who will bear the consequences. Mediators do not inflict their own judgments or solutions.

Mediation is consensual
Participants take part in the mediation process only if they want to and may end the mediation at any time..

Mediation is confidential. Mediation sessions are not public and any disclosure of the information the parties shared is prohibited. The notes the mediator takes during sessions are destroyed in the presence of the parties at the end of the mediation procedure

Mediation is time saving
The appointment for a mediation procedure takes a few days and the agreement may be reached very soon. This way, you will save the time you need to end the conflict through court

Mediation is convenient
Mediation sessions take place in the afternoons ( Monday - Friday) and in the morning ( Saturday).

Who are the mediators?
Mediators are specially trained in the field and are authorized by the Minister of Justice. Their purpose is to facilitate the communication between the parties in dispute
Will you need a lawyer?
We encourage parties in the mediation procedure to get all the legal information they need to make the best decisions. Taking legal advice is an important part of the process. We may be assisted or represented by your lawyer in the mediation.
More about UCMR
As a program initiated by the Mediation Centre in Craiova with the aid of the Cultural Centre of the US Embassy , the Minister of Justice and the bars of Romania, mediators have been trained since 2005 in Craiova under the supervision of American mediators with an extensive practice in Washington DC- US. As a result of this training in Craiova, Centres of mediation were initiated all over the country in each of its counties, those constituting the Federation.

What types of conflicts may be mediated?
Mediation may be used in resolving a wide variety of conflicts
• Civil law: Recoveries of property, claims, eviction, partition of property
• Family Law: Divort, Partaj bunuri comune, Incredintare minori etc.
• Criminal law: If settlement is not prohibited
• Commercial Law: Orders of payment, claims, recoveries of property, eviction etc
• Labor Law: Caiming wages, indemnities, wrongful termination of contract
And others...
Mediation sessions may be set for any type of conflict where parties accept dialogue as means to clarify their interests on the way of reaching a mutual agreement.
The judiciary taxes are refunded
In case the dispute is settled through mediation, the court will acknowledge the settlement according to art. no. 271 – civil procedure code, at the parties’ request and will grant the interested party the refunding of the judiciary tax
